Present:      Complainant – DH in person with Counsel.

Order

          On 04.06.2015, the complainant –HD has made a statement that he has received the cheque no. 832901 dt. 04.05.2015 worth Rs. 30456/- from the respondent –JD. He has also delivered the copy of RC, copy of insurance and from 30 after signing the same to shri L.K. Doda, Adv.. He further stated that on 11.06.2015 he will also sign them power of attorney and letter of subrogation for transfer of the vehicle. He further stated that he does not claim the penalty from the JD/ Divisional manager and he has no objection if the penalty is waived.

          Today 11.06.2015 ld. Counsel for the respondent –JD has made a statement that he has received the special power of attorney and indemnity bond dully executed from the complainant-DH. The respondent-JD has already made the payment to the complainant-DH.

          Complainant in person has also made a statement that keeping in view the statement of the ld. Counsel for the respondent-JD, the present execution petition may be dismissed as withdrawn.. However, the respondent-JD be directed to provide the photo copy of special power of attorney and indemnity bond.

Heard.

Keeping in view the statement made by the complainant, the present execution stands dismissed as withdrawn. The penalty imposed upon the respondent-JD stands dismissed waived because the complainant has given his no objection in this regard. However, the respondent-JD is directed to provide the photo copy of the special power of attorney and indemnity bond to the complainant-DH.

File be consigned after due compliance.
