Penultimate plea of learned counsel for the Insurance Company is about failure of complainant to apply permanent registeration number of the insured vehicle and further delayed intimation about loss/theft of the insured vehicle to the Insurance Company. These pleas pales into insignificance in the light of decision of NCDRC reported as HDFC Chubb General Insurance Company Ltd. vs. Ila Gupta 2007(1) CPC 432 that if the insurer was so stick about compliance of such condition it should have cancelled the policy within a reasonable time- Non-registration of vehicle was not the cause of the accident nor equally it can be said in theft case. The delayed intimation by the complainant to the Insurance Company does not scuttle his just and genuine claim in the peculiar circumstances of the case as firstly Insurance Company issued only a cover note to the complainant and policy was filed by the Insurance Company in favour of the complainant and also no time frame is mentioned in clause 1 of the condition but the complainant definitely intimated about theft of vehicle in question to the Police vide Ex.OP2 on 20/8/06.<br /> In the ultimate analysis of aforesaid discussion, we are of the considered opinion that impunged repudiation of the claim vide letter dated 21/9/07 is illegal being contrary to the conditions of the policy which amounts to deficiency in service on the part of opposite party and order opposite party to pay to the complainant amount of Rs.34020/- ID value minus permissible depreciation alongwith interest @ 9% p.a. from the date of repudiation till realisation and also monetary compensation of Rs.4000/- for mental azagony and physical harassment due to deficiency in service besides Rs.1000/- as cost of litigation within a period of one month from the receipt of copy of this order.<br /> Let certified copies of judgment rendered be supplied/despatched to the parties without any unnecessary delay and thereafter file be consigned to record room.<br /> <br /> Announced : ( Surinder Mittal ) ( A.K.
