During the course of arguments, it has been found that complainant has already submitted on the file report lodged with the police ex.C-4, copy of the RC ex.C-3, copy of the FIR with which the case of the complainant is attached by the police ex.C-5, untraced report ex.C-6, FIR status report ex.C-7 and untraced report submitted by the police with Ilaqa Magistrate ex.C-8. However, complainant has not submitted report sent to the NCRB, New Delhi. Opposite party has yet not decided the claim case of the complainant. Opposite party cannot press the complainant insured to get independent individual FIR in respect of the theft of the vehicle. Opposite party has demanded independent FIR which is not possible for the complainant to submit. However, NCRB report is liable to be submitted by the complainant to the opposite party before the case of the complainant is settled. So, document generally required by the opposite party from the complainant is only NCRB report. Counsel for the opposite party submitted that if the complainant submits the NCRB report and furnishes other relevant documents i.e. transfer of the RC in the name of the opposite party, power of attorney, letter of subrogation, NCRB report and no due certificate from the financier, with the opposite party, opposite party is ready to decide the claim case of the complainant. Complainant himself stated at bar that he shall furnish the aforesaid documents to the opposite party within 15 days from the date of receipt of copy of orders.
Resultantly, with the consent of both the parties, present complaint is disposed of with directions to the complainant to submit the aforesaid documents with the opposite party within 15 days from the date of receipt of copy of this order and opposite party shall decide the claim case of the complainant within one month from the date of receipt of aforesaid documents from the complainant. Keeping in view the peculiar circumstances of the case, parties are left to bear their own case. Copies of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room.
