Applicant submitted before this Forum that he could not submit the papers to the respondent i.e. letter of subrogation, power of attorney and papers regarding transfer of RC of the vehicle in favour of the respondent. So, he does not claim interest on the IDV of the vehicle in question and he is ready to submit these papers complete in all respects to the respondent within 2 days from today. Counsel for the respondent Sh.Sandeep Khanna, Adv.got recorded his statement that applicant shall submit these papers in the Divisional Office No.III of the respondent Insurance company situated at Queens Road, Amritsar and payment of the claim of the applicant i.e.IDV of the vehicle in question alongwith litigation expenses shall be made to the applicant within one month from the date of receipt of documents from the applicant. Applicant further got recorded his statement that he has heard the statement of the counsel for the respondent and present execution application may be disposed of accordingly.

So, in the light of the statement of the applicant countersigned by the counsel for the applicant Sh.Nitin Madaan, Adv.and counsel for the respondent, present execution application is disposed of with directions to the applicant to submit these papers within 2 days from today in the Divisional Office No.III of the respondent Insurance company situated at Queens Road, Amritsar and the respondent shall receive these documents and bear the expenses of the transfer of the RC and shall make payment of IDV of the vehicle in question, to the applicant alongwith litigation expenses Rs.2000/- within one month from the date of receipt of the aforesaid documents from the applicant. Copies of the orders be furnished to the parties free of costs. File is ordered to be consigned to the record room.
