Final Order / Judgement

Sh. Atul Singh (Authorised Signatory) is present on behalf of the Hero Reality Pvt. Ltd. - appellant alongwith his counsel Sh. Chitradeep Rana; Sh. Nathu Singh-respondent in person is also present.

Both the parties’ and learned counsel for the appellant have stated before the Commission that both the parties have filed a compromise application on 08.11.2021, wherein in Para No. 6(iii)), it is stated that within 30 days after receiving all the balance consideration amount and other charges from the respondent, the appellant company shall execute and register the sale-deed in favour of the respondent-Sh. Nathu Singh in respect of the plot in question and the parties further acknowledged that the stamp duty and registration charges shall be borne and paid by the respondent therein.

Sh. Atul Singh (Authorised Signatory) for the appellant company has admitted before the Commission that the balance amount of Rs. 1,60,388/- (Rupees One Lakh Sixty Thousand Three Hundred Eighty Eight Only) has been paid by the respondent to the appellant and the appellant company is agreed to execute the sale-deed of the plot in dispute within the period as mentioned in the compromise. 

Thus, the aforesaid compromise is accepted; the appeal is decided accordingly on the basis of compromise.

The compromise shall form part of the order.

          

Later on today, an application moved by both the parties, it is stated that the appeal has already been decided on the basis of compromise.  Now, the court be pleased to order for withdraw the statutory amount, i.e. Rs. 25,000/- to the appellant. The respondent has no objection against it, hence, the aforesaid application is hereby allowed and the appellant be allowed to withdraw the statutory amount.
