Today is fixed for taking necessary steps by the Complainant. But the Complainant is found absent on calls. O.P. 1 is present. O.P. 1 submits that the Complainant has received Rs. 1,50,000/- on the basis of the claim of the instant complaint case. In support of his contention O.P. 1 has filed Bank Statement. Seeing the Bank Statement we prima facie find that Rs. 1,50,000/- has been transferred from NASHIPUR H.S. E.C.C.S. LTD on 23.05.2023 vide cheque No. 153469 through NEFT to the complainant, Md Nuhiruddin. Considering the facts and circumstances of the case we are of the view that the instant case is not required to be proceeded with in the absence of the Complainant.

   Hence, it is

ORDERED

that the instant case No. CC/21/2022 is filed.

Let plain copy of this order  be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand  /by post under proper acknowledgment  as per rules, for information and necessary action.
