Per Mr. S.R. Khanzode, Hon’ble Judicial Member :

 

          This appeal is a cross appeal preferred by the original complainant.  Since he is not satisfied with the quantum of compensation awarded as per impugned order dated  09.02.2010 passed in consumer complaint No. 426/2005, Gajanan  Patil V/s Narsee Monjee Institute of Management Studies  (Deemed University) & Ors.  by Additional District Consumer Disputes Redressal Forum, Suburban Mumbai, Bandra, Mumbai ( ‘the Forum’ in short).

          It is the grievance of appellant/complainant that his claim for refund of entire course fees ought to have been allowed.

          Heard both sides.

          The sister appeal filed by respondent/original opponent bearing No. 362/2010 stand dismissed by a separate order, today itself. 

          This appeal for the reasons mentioned, infra, is also devoid of any substance.  The grievance of the appellant/complainant pertains to a misleading prospectus whereby he understood to have undergone a degree course but in fact, he was awarded a Diploma.  He has already completed the course.  Therefore, refund of entire fees by way of compensation is not justified and rightly so held by the Forum.  Thus, we find the appeal for enhancement is devoid of any substance.  We hold accordingly and pass the following order :

                                      O R D E R

          The appeal stand dismissed.

 In the given  circumstances, both the parties to bear their own costs.
