NAWAB SINGH J.(ORAL)

Punjab and Sind Bank-opposite party (for short, ‘bank’) has filed the present appeal against the order dated February 27th, 2017 passed by District Consumer Disputes Redressal Forum, Yamuna Nagar (for short, ‘District Forum’) whereby complaint filed by Narinder Kumar Aggarwal and Amit Aggarwal-complainants was allowed. The bank was directed to pay Rs.20,000/- compensation and Rs.5000/- litigation expenses to the complainant.

2.      Today, that is, May 11th, 2018 the complainants moved an application stating therein that the matter has been settled with the bank.  They do not want to claim the awarded amount, that is, Rs.20,000/- and Rs.5000/- from the bank.

3.      In face of it, learned counsel for the appellant-bank has supported the statement of the complainants.

4.      Since the matter has been settled between the parties and the complainants forego their claim, the impugned order is set aside.  The appeal stands disposed of accordingly.

5.      The statutory amount of Rs.12,500/- deposited at the time of filing the appeal be refunded to the appellant against proper receipt and identification in accordance with rules, after the expiry of period of appeal/revision, if any.
