Delay of 21 days in filing the revision petition is condoned. The District Forum directed the petitioner/opposite party to pay Rs.4,000/- to the respondent/complainant with interest @ 9% p.a. from 07.09.2009. Rs.11,000/- were awarded by way of compensation and Rs.2100/- as costs. Petitioner being aggrieved filed the appeal before the State Commission without complying with second proviso to Section 15 of the Consumer Protection Act, 1986 which provides that no appeal shall be entertained by the State Commission unless the appellant -2- deposits 50% of the amount awarded or Rs.25,000/- whichever is less. In spite of opportunity given, petitioner did not deposit 50% of the awarded amount. State Commission refused to entertain the appeal and dismissed the same. Petitioner being aggrieved has filed the present revision petition. Since the amount involved is meager and the costs of litigation would be much more than the amount involved, we decline to interfere with the impugned order and dismiss the revision petition. Question of law is left open. |
