            Shri Yash Vidyarthi, learned counsel for the respondent no.1.

As per Shri Justice Shantanu S. Kemkar :                       

                        Feeling aggrieved by the order dated 23.12.2010 passed by the District Consumer Disputes Redressal Forum, Sagar in C.C.No.151/2010, the appellant/opposite party no.1 has filed this appeal.

2.                     We find that the Forum has not properly appreciated the stand taken by the appellant bank to the effect that they are not liable to pay compensation as claimed by the complainant and the Forum has also not considered the documents on record and the other objections raised by the opposite parties indicating that some other co-operative bank was liable for compensation, if any, to be payable to complainant.

3.                     Having gone through the record we find that the impugned order is not sustainable as various grounds taken by the opposite party have not appreciated by the Forum as also the Forum has not considered the documents filed on record and passed the impugned order.

4.                     In the circumstances, we set-aside the impugned order and remand the case back to the District Forum for deciding the complaint afresh on merits in accordance with law. Parties are directed to appear before the Forum on 21.05.2019.

5.                     With the aforesaid observation, this appeal is disposed of.
