The M.A. petition No. 18/2023 is taken up and heard both sides.
Heard both sides of the petition regarding maintainability filed by the opposite party.
Perused the petition, written objection and also the case record. Considered all materials thoroughly.
It appears that there is mixed question of law and facts regarding prayer for non-maintainability which cannot be decided at this stage without evidence. This issue will be decided at the time of final disposal of the case.
