Complaint in brief :-
Complainant paid an advance amount of Rs. 25,000/- towards arranging an American tour programme scheduled for 13 days with the opposite party. Total amount fixed was Rs. 2,65,000/-. The tour was scheduled to start on 23/04/2014. Opposite party promised to return the advance amount in case of cancellation of tour programme. Complainant was on medication for diabetics, and blood pressure. Within 2 days of booking, complainant fell ill and the doctor advised not to travel. Hence complainant intimated opposite party to cancel the tour and return the advance paid. So far opposite party has not returned the advance amount. Hence the complaint.
Complaint posted for hearing on admission. Heard complainant. It is seen that opposite party carries business at Ernakulam and has no branch office within the Jurisdiction of the forum. Further no cause of action wholly or partly arose within the Jurisdiction of the forum. Hence Forum lacks Jurisdiction to entertain the complaint.
Hence without going in to the merits of the case, we dismiss the complaint with direction to approach appropriate forum for relief.
