         Both sides represented.  Parties filed joint statement  to the effect  that dispute between the parties is settled out of court, paying Rs. 66,000/- by  the appellant to the respondent.  Appeal need not be proceeded further and appeal is closed, as withdrawn.  Refund amount of Rs. 21,000/- deposited by the appellant at the time of filing appeal on his application .
