Sh. Anurag Nautiyal, Advocate, holding brief of Sh. Nishant Chaturvedi, learned counsel for the appellant and Sh. S.M. Joshi, learned counsel for respondent No. 2, are present.  None is present on behalf of respondent No. 1.

An application has been filed on behalf of the appellant to withdraw this appeal, stating therein that the appellant, who was opposite party No.1 to the consumer complaint and respondent No. 1, who was complainant to the consumer complaint, have entered into compromise.  A Deed of Settlement regarding compromise has also been annexed with the application.

Learned counsel for the appellant states that the appeal may be dismissed as withdrawn.

Accordingly, the appeal is dismissed as withdrawn.  The amount deposited by the appellant with this Commission, be released in its favour.
