F I N A L O R D E R
Sri. Siddhartha Ganguli( President-in- Charge):- An application has been filed by the Complainant U/S 35 of the C.P. Act, 2019, alleging deficiency of service against the O.Ps for providing lesser area of the garage/property and therefore the Complainant has filed the Complaint praying for proper reliefs as per the prayer as mentioned in the petition.
During the proceeding of the case, the Complainant remained absent and that is why this Commission has passed an order directing the Complainant to file Show cause on 26.05.2023. Even after that the Complainant did not turn up and therefore this Commission has passed an order dismissing the case for default, being order No:- 32, dated 19.06.2023, which be treated as part of this Order.
Most probably the complainant has lost interest in the case and does not want to proceed with the case any further. He has also failed to file the answer to the show cause as directed which is supposed to be filed today.
Therefore, the case is liable to be dismissed for default.
Hence,
it is ordered that the instant Consumer Complaint, being no. C.C/12/2021 is dismissed for default.
