The appeal filed by the petitioner bank before the                           State Commission came up for hearing on 18.12.2008, on which date notice was issued for admission for 30.3.2009.                                     The State Commission granted the Stay subject to the petitioner’s writing a letter to the respondent offering him the amount                 provided the respondent cancels the membership.  Petitioner did not                       do so and instead, filed an application for extension of                             Stay from 18.12.2008 to 30.3.2009.

The State Commission extended the Stay making it clear to the petitioner that non-compliance of the order will result into dismissal of the complaint. 

Aggrieved against the order passed by the State Commission, the petitioner filed a revision petition No.2359/2009 which came up for hearing before this Commission on 16.7.2009.  The revision petition was dismissed as the same had been filed against an Interim Order during the pendency of the appeal before the State Commission.  Thereafter, the petitioner filed a Review Applciation which came up for hearing on 01.10.2009.  The Review Application was dismissed.  However, it was made clear that the order will not prevent the petitioner from filing a revision petition against the final order passed by the State Commission on merits.

          Thereafter, petitioner filed another application for extension of Stay which came up for hearing on 18.6.2009.  The same has been dismissed by the impugned order.

            Petitioner has filed the present revision petition before passing of final order by the State Commission on the plea that he had been put at liberty to file the revision petition against the final order passed by the State Commission.  The final order has yet not been passed by the State Commission on merits.  The revision petition is frivolous and is dismissed with costs which are assessed at Rs.5,000/-.  Costs be deposited with Consumer Legal Aid Account within a period of four weeks.
