The appeal taken up for hearing. Sri M.N. Misra for the appellant is present. Appeal no.2130 of 2006 and Appeal no.2626 of 2014 were taken up for hearing. From perusal of the records, it transpires that the UPPCL preferred the Appeal no.2130 of 2006 against the judgment and order dated 12.5.2006 by the Ld. DCDRF, Agra in complaint case no.116 of 2005 in which notices were sent to the respondent/complainant Sri Nafisuddin for filing objections.

From perusal of the records, it transpires that the respondent/complainant Sri Nafisuddin filed objections on 22.12.2014. However, due to clerical mistake, it was not kept in Appeal no.2130 of 2006 but was registered as a separate appeal bearing no.2626 of 2014. This is a clerical mistake and vide order of this Bench dated 22.9.2015, the office was directed to rectify the same. However, it has not been done so far. Appeal no.2626 of 2014 be assimilated/ merged with Appeal no.2130 of 2006. The office is directed to comply with the order forthwith. Appeal no.2130 of 2006 alongwith assimilated/merged appeal no.2626 of 2014 be placed before the court on 7.12.2015 for further orders. Accordingly, the matter (appeal no.2626 of 2014) stands disposed of.
