Complaint under  Sec.12 of the CPA 1986 as amended upto date

          The complainant had purchased a TATA Indicom mobile bearing no. 9218130981 from OP – 1.  At the time of the purchase it was re-presented to him that he will be granted 90000 second of talk time.  The grievance of the complainant is that the said assurance has not been complied with.  Hence, the complaint.

           The complaint has been contested by OP – 2 who have filed a W.S.  OP – 2 has admitted that the complainant was entitled to a talk time of 90000 seconds within a period of six months which was subject to minimum base recharge.    It is however, stated that as a goodwill gesture and only for avoiding any unnecessary litigation OP – 2 was ready to provide the complainant the balance talk time remaining to 90000 seconds irrespective of the fact that the complainant was not entitled for the same.

      In view of the admission, we direct the OP to provide to the complainant the balance talk time remaining out of 90000 seconds. 

          We further direct OP to pay a sum of Rs.2500/- as litigation charges.

           With these observations we dispose off this complaint.

Copy of the order be made available to the parties as per rule.

File be consigned to record room.
