The brief facts as set out in the case are that the complainant is a electricity consumer 5-3-2005. Daulat Khanu, W/o.Habib Saheb but the opposite party has changed her name as Daulat Khan. 14-5-2007
Opposite party did not choose to file any counter.
The District Forum based on Exs.A1
Aggrieved by the said order, the complainant preferred this appeal.
The learned counsel for the appellant/complainant filed material papers of receipt dated4-5-20053-5-2005 6-3-200618-3-20066-3-2006. 18-3-20064-5-2005
The learned counsel for the respondents/opposite parties submitted that the name was corrected during the pendency of the complaint before the District Forum and the mistake showing Rs.167.93 towards arrears has also been rectified. 6-3-2006
However, the compensation of Rs.2 lakhs prayed for by the complainant has not been supported by any documentary evidence and we are of the considered view that the compensation and costs of Rs.500/- awarded by the District Forum can be increased to Rs.1,000/- towards compensation and Rs.1000/- towards costs.
In the result this appeal is allowed in part and the order of the District Forum is modified by directing the respondents/opposite parties to rectify and not to show arrears in the future bills and also by enhancing the compensation to Rs.1,000/- and also awarding costs of Rs.1,000/-. Time for compliance four weeks, failing which the amount awarded would attract interest at 9% p.a.
