 This C.C. coming on before us for final hearing on 19-4-2012 in the presence of K. Gopal, the complainant in person and Sri C.Rajender Kumar, Advocate, Mahabubnagar for the opposite party and the matter having stood over for consideration till this day, this Forum made the following:   

 

O R D E R

 

          Affidavit of complainant not filed. Further the complainant is called absent. Perused the material on record. It is seen from the record that the present complaint is filed against the opposite party for awarding compensation against OP for non furnishing the required information to his application applied under RTI Act.  But in a recent decision rendered by the Hon’ble National Commission it is held that the petitioner can not be claimed to be a consumer under the C.P. Act since there is a remedy available for the complainant to approach the appellate authority U/s 19 of the RTI Act, 2005. In view of the aforesaid decision, we find that the present complaint is not maintainable before this Forum. Under the said circumstances, the complaint is returned to the complainant for presentation before the concerned appellate authority U/s 19 of the RTI Act, 2005.
