1. Complainant is not appearing in this case since 2.5.2016, 13.7.2016 and today counsel of the National Insurance Company has filed an application that the stolen vehicle which is subject matter of the present complaint has been recovered by the police and complainant has got the delivery of the vehicle. Copy of the SuperdariNamasubmitted by the complainant has been filed , therefore, it is prayed that an appropriate order be passed. 
2. Heard the counsel for insurance company and perused file. 
3. Complainant filed this complaint alleging that his insured vehicle Maruti Swift was stolen on the night of 26.4.2014.Accordingly an FIR no. 301/2014 dated 27.7.2014 was registered U/s 379 at PS Mianwali Nagar, Delhi.Hence he claimed the IDV of the vehicle i.e. Rs5,49,689/- along with compensation and cost of litigation.   As the recovered vehicle has been handed over to the complainant  by the MM, Tis Hazari Court, Delhi  vide SuperdariNamadated 21.4.2016 in FIR no. 301/2014 , therefore, in absence of the complainant it will be abuse of process to continue this case. Hence the case is dismissed in default.

4.Copy of the order be made available to the parties free of cost as per law.  File be consigned to record room.
