Cosumer Forum consumer case(CC) CC/11/14 Of 2011 M/s Maa Durga Cotton Complainant Versus N.I.A. Co. Respondent For Complainant IN person For Respondent A. Sharma Present complaint has been filed by the complainant against the New India Assurance Company for non-settlement and repudiation of the claim. 2. Heard. 3. The counsel for the opposite parties stated that the claim was repudiated because of the reason that the complainant was not co-operating with the surveyor/investigator. He failed to submit required documents and also failed to provide sufficient information as required for the settlement of the claim. The New India Assurance Company time and again approached the complainant and had also written so many letters to the complainant, but to no effect. 4. On the other hand, the counsel for the complainant stated that the complainant was ready to co-operate with the New India Assurance Company. The counsel for the complainant further stated that the complainant is still ready to provide the information as required by the insurance Company for the settlement of the claim. 5. In view of the submissions of the counsel for the parties, we dispose off the present complaint with a direction that the New India Assurance Company by written registered letter will ask for the information/documents, required to be supplied by the complainant, within seven days from the date of receipt of copy of this order. It is made clear any documents/information which under normal circumstance will not supposed to be in possession of the complainant or to which under normal circumstances, the complainant will be unable to supply, will not be asked from the complainant Thereafter within seven days from the date of receipt of the said letter, the complainant will provide the information/documents to the New India Assurance Company and the New India Assurance Company will settle the claim of the complainant within thirty days thereafter. We hope that the New India Assurance Company would consider the claim of the complainant with a positive attitude and will not make unnecessary or unwanted objections for the settlement of the claim. If the complainant will not be satisfied with the claim settled by the opposite parties, he will be at liberty to approach this Forum by way of filing afresh complaint.
