JUDGMENT

None for the DH. Counsel for the JDs present and he has moved an application for dismissing this execution case on the ground that the appeal filed by the JDs has been allowed by the Hon'ble National Commission and the impugned order dated 22.11.2007 passed by this Commission in complaint case no.129 of 2002 has been set aside.  A copy of the order passed in FA no.125 of 2008 and FA no.285 of 2008 has been filed in support of his contention.

It transpires that in complaint case no.129 of 2002 filed by Neelam Cold Storage, the DH, this Commission has passed order on 22.11.2007 as under:-

"परिवाद आंशिक रूप से स्‍वीकार करते हुए तदनुसार आदेशित किया जाता है विपक्षी इस आदेश की सत्‍य प्रतिलिपि प्राप्‍त होने के अगले 2 माह के अन्‍दर रूपये चार लाख उनतीस हजार साल सौ उनतीस मय 6 प्रतिशत ब्‍याज साहित परिवादी को अदा करें।

     ब्‍याज की गणना परिवाद प्रस्‍तुत करने की तिथि से वास्‍तविक भुगतान की ति‍थि तक की जायेगी।

 पक्षकार अपना-अपना वाद व्‍यय स्‍वंय वहन करेंगे।

     निर्णय की प्रतिलिपि पक्षकारों को नियमानुसार उपलब्‍ध करा दी जाये।"

The complainant/DH filed the instant execution against the JDs. Meanwhile, the JDs/appellants filed an appeal no.125 of 2008 and the DH/complainant also filed an appeal no.285 of 2008 before the Hon'ble National Commission against the order passed by this Commission on 22.11.2007. Both the appeals have been decided, as is evident from the order passed in FA no.125 of 2008 and FA no.285 of 2008 by the Hon'ble National Commission vide order passed on 12.9.2014 whereby the appeal filed by the JD was allowed and the impugned order of this Commission was set aside. Also the appeal filed by the DH/complainant for enhancement of compensation was dismissed.

There is none from the side of the DH to state anything. From the aforesaid order of the Hon'ble National Commission, it is clear that order passed by this Commission on 22.11.2007 in complaint case no.129 of 2002 has been set aside and the appeal no.125 of 2008 has been allowed by the Hon'ble National Commission therefore, this execution is to be dismissed as the order dated 22.11.2007 has itself been set aside by the Hon'ble National Commission.  

Accordingly, this execution application is dismissed.

Certified copy of the judgment be provided to the parties in accordance with rules.
