ORDER

Complaint is partly allowed. If site No.1375 situated at Hanchya and Sathagalli (B Zone), Mysore measuring 30 ft X 40 ft. is not allotted to some other person, the same site should be allotted to the complainant under same terms and conditions, as per the letter of allotment dated 25-2-01. Any how, the complainant is liable to pay interest to MUDA from 21-07-05 on which date the complainant came to know about such allotment and cancellation. If, site No.1375 is alloted to some other person, the O.P. is directed to allot a similar site with similar cost to the complainant, within a period of 6 months on the same terms and conditions. If O.P. fails to allot a site as mentioned above, the complainant is at liberty to approach the Forum, seeking suitable damages on the ground of deficiency in service. Return the original records to learned counsel for O.P. Parties to bear their costs. Give a copy of this order to both parties according to Rules.
