                Today the case is fixed for consideration on the point of maintainability.  Heard.  The complainant has filed the two complaints bearing No.177 and 178 instituted on 26.06.2019.  This Forum has given direction to the complainant to place on file photo-copy of the product.  The complainant has alleged that he has ordered for Nivea Body Lotion on 18.05.2019 and 30% discount was offered on the said product.  The MRP of the Nivea Body Lotion was Rs.140/- and after 30% discount, the price of the Body Lotion was shown as Rs.98.31/.  The order billing details showed the discounted price as Rs.98.31 + tax Rs.8.85 (CGST) + Rs.8.85 (SGST) and total Rs.116/- was charged from the complainant.  The grievance of the complainant is that after giving the discount on the MRP, they cannot charge the CGST or SGST.  In this way, the Op No.2 has taken the extra price of Rs.17.70 paise as CGST as well as SGST. 

                We have perused both the file, which reveal that the complainant is the same in both the cases.  The complainant has cleverly filed both the cases on the same invoice.  We have tally the invoice in both the files.  It is clear that the invoice is the same of the same product and invoice number is the same.  In this way, the complainant has filed the second complaint on the same product on the same ground.  Hence, the present complaint bearing No.178 dt. 26.06.2019 is not admitted on the point of maintainability and hence, the same is hereby dismissed on the point of maintainability at the stage of admission.  A copy of said order be supplied to the complainant free of costs.  File be consigned to record-room after due compliance.
