The complaint was filed by the complainant under section 35 of the Consumer Protection Act 2019 alleging deficiency in service not delivering the product along with a prayer to direct the opposite party to refund a sum of Rs.3499/- along with interest and to pay a sum of Rs.10,000/- towards compensation for the mental agony and hardship caused to the complainant due to the deficiency in service and unfair trade practice on the part of the opposite party along with cost of the proceedings to the complainant.
No representation for complainant. Paper Publication not effected for opposite party. Proof affidavit not filed by the complainant. Sufficient opportunities given for appearance of complainant on 28.07.2022, 22.09.2022, 10.10.2022, 27.10.2022, 15.11.2022, 24.11.2022, 30.11.2022, 12.12.2022, 21.12.2022 and on 30.12.2022. In spite of the same, complainant failed to appear and prosecute the case. Hence, this commission is of the view that no purpose in keeping the complaint on file. Hence the consumer complaint is dismissed for non prosecution. No cost.
