            Heard.

Applicant has filed this MJC against the order dated 4.8.2015 passed by this Commission in appeal No.1999/14, whereby the appeal has been dismissed for want of prosecution.

The Apex Court in the case of Rajeev Hitendra Pathak and others vs. Achyut Kashinath Karekar and another 2011 (8) SCJ 308 has held that the District Forums and State Commissions do not have the power to review/recall their orders.

In view of above legal position proposition, counsel for applicant seeks to withdraw this application with liberty to challenge the impugned order before appropriate forum.

Prayer allowed.

 

 

Subject to liberty aforesaid, this MJC is dismissed as withdrawn.
