None appears on behalf of the parties to the Revision Petition despite repeated call.
Today is fixed for hearing of the Revisional Application.
It is the settled principle of law that the Revisional Application cannot be dismissed for default. It should be heard on merit.
Perused the Revisional Application submitted by the Revisionist/Petitioner Somdeep Ganguly challenging the impugned order dated 29-04-2021 order No.4 passed by DCDRC, Unit-III, Kolkata in CC case No. 294 of 2021.
Perused the impugned order dated 29-10-2021 passed in complaint case No. CC/294/2021 by the Ld. DCDRC, Kolkata, Unit-III(South). By dint of impugned order the Ld. Commission below was pleased to hold to the effect that “in such a situation without a giving opportunity to the O.P of being heard in the matter we are not inclined to pass any restraining order /stay order prayed for by the Complainant.”
On meticulous perusal of the impugned order we do not find any illegality, irregularity or impropriety in the impugned order passed by the Ld. Commission below. In our considered view the impugned order does not deserve interference of this Commission. Ld. DCDRC will proceed to dispose of the complaint case in accordance with law.
In the results, the present Revisional Application is rejected on merit.
Let a copy of this order be transmitted to Ld. Commission below at once for information and taking necessary action.
Thus the Revisional Application being No. 34/2021 stands disposed of.
