By Smt. Padmini Sudheesh, President:

The case of complainant is that the complainant deposited Rs.50,000/- with the respondent finance on 30.8.03. The agreed rate of interest was 16.5%.  The interest was received till 30.6.07 and after that no interest was given. The complainant requested to return the amount several times but there is no payment so far. So the complainant was caused to send lawyer notice and it was returned as unclaimed. This act of the respondent is deficiency in service and this complaint is filed.

            2. All the respondents are called absent and set exparte.

            3. In order to prove the case the complainant filed Affidavit and three documents which are marked as Exts. P1 to P3 series.

            4. According to the complainant, the amount deposited by the complainant as per Ext. P1 receipt is not returned to him. According to him till 30.6.07 interest was given to him. So he is entitled to get the principal amount and interest after that period. There is no evidence to the contrary.

            5. In the result, the complaint is allowed and the respondents are directed to return the Ext. P1 amount with interest at the rate of 16.5% per annum from 30.6.07 till realization with cost Rs.500/- (Rupees five hundred only) to the complainant within two months.
