            The complaint is filed to realize Rs.1,25,000/- being the amount deposited in the respondent firm with interest. The complainant has deposited Rs.1,25,000/- in the respondent finance company on 28.7.1998 vide receipt No.199/08. It was agreed to give him interest at the rate of 12%. But no interest was paid from 31.12.05. The petitioner requested to refund the deposit amount several times. But the amount has not paid. On 6.11.06 a lawyer notice was issued. But there was no reply and remedy. Hence the complaint.
 
            2. Respondents called absent and set exparte.
 
            3. The petitioner has filed affidavit and 3 documents to prove his case and they are marked as Ext. P1 to P3.
 
            4. This is a case filed by the complainant to realize the deposit amount with interest. The petitioner has deposited Rs.1,25,000/- on 28.7.1998. The amount has not refunded even after several demands. So he seeks the amount, compensation and costs.
 
            5. There is no contrary evidence.
 
            6. In the result, complaint is allowed and the respondents are directed to return the fixed deposit amount with interest at the rate of 12% per annum from 1.1.06 till realisation and also directed to pay Rs.1000/- (Rupees one thousand only) towards costs to the complainant.   Comply the order within two months.
