Final Order / Judgement

JUDGMENT

  1. The present complaint has been filed by the complainant before this commission for  the following reliefs-
  1. The OP no.1 be directed to pay the price of the mobile Rs.30000/ with interest at the rate 18%.
  2.  The OP no.1 be directed to pay Rs.400000/ as compensation for harassment.
  3. Cost of the case be awarded against the Ops.
  1. The Complainant has stated that he had purchased a mobile set of the Samsung company on 01.10.2022 for Rs. 30000 from the OP no.3. The screen of the mobile set was damaged within the grantee period. Complainant made a complaint Samsung customer care executive where he was asked to approach to OP No.2 where the set was not replaced. Complainant deposit the set on 27.10.2022 at op no.2 but the mobile set was not replaced .
  2. Ops did not contest the case despite of sufficient service and case was processed ex- parte against them. Later on op no.1 moved an application to set aside ex-parte order and to admit WS and affidavit on record. The application was rejected as being moved for filing WS beyond 45 days as required under the provisions of Act.
  3. Complainant has filed his affidavit and papers  in support of his pleadings.
  4. We have perused the material available on record  and heard the complainant.
  5. There is unrebutted pleadings supported by affidavit and documents and thus the complainant case stand proved. Complainant is entitled for reliefs claimed .
  6.  We hereby direct Ops to pay complainant jointly and severally either to replace the mobile set of same brand or  to pay the price of the mobile set Rs. 30000/ with pendente lite and future interest at the rate 12% per annum, compensation for harassment at Rs. 10000/ and litigation expenses Rs. 10000/.
  7. A copy of this judgment be provided to all the parties as per rule as mandated by Consumer Protection Act, 2019. The judgment be uploaded forthwith on the website of the commission for the perusal of the parties.
  8. File be consigned to record room along with a copy of this judgment.
