The appeal is called at the end of the board i.e. at 1.00 p.m. for appropriate order as the appellant failed to appear on last 5 dates.
Adv. Mr S Saoji is present for respondent Nos.1 & 2 and he submitted that the appeal may be dismissed in default as none has appeared for the appellant on last five dates.
None is present for respondent No.3.
Perusal of the daily proceedings shows that Adv. Mr Mohit P Bhansali had appeared for the appellant lastly before this Commission on 04.09.2014 and on that date delay in filing of the appeal was condoned and the appeal was admitted. Both parties were directed to file their Written Notes of Arguments on next date. The appeal then came to be adjourned on 18.02.2015. However, though the appeal came to be adjourned on 18.02.2015, 06.05.2015, 17.07.2015, 26.10.2015 and 20.11.2015, none appeared for the appellant on those dates.
The appellant has also not filed Written Notes of Arguments till this date. Therefore, the appeal has been adjourned for appropriate order till this date.
Today also none appeared for the appellant and appellant has not filed Written Notes of Arguments. Therefore, the appeal deserves to be dismissed in default.
Accordingly, the appeal is dismissed in default.
No order as to costs.
Copy of the order be supplied to both parties free of cost.
