ORDER

Complaint is filed for possession of site No.530 measuring 6 metere by 9 metre and situated in Bogadi 2nd stage, Mysore and compensation of Rs.1,00,000/- for mental agonyt and expenses caused to complainant by the opposite party. It is the case of the complainant that on his application the opposite party allotted him the said site but did not deliver him the site despite many representations given by him to opposite party and payment of certain amount. The opposite party has not chosen to file his version to the complaint. The complainant was called upon to adduce evidence on affidavits and original documents relied upon by him. He has not chosen to file any affidavit or document. Thus there is no evidence on record to prove his case. The fact that the o.p. has not filed his version on affidavit does not help the complainant to prove his case. When the complainant has not proved his case he is not entitled to any relief sought for. Therefore we dismiss the complaint. Therefore we dismiss the complaint.
