Proxy advocate of the appellant file letter of authority alongwith Pursis and he submits that in view of the recent decision of the Hon’ble Apex Court in the case of UP Power Corporation Ltd & Ors. Vs. Anees Ahmed, reported in AIR 2013 Supreme Court - 2766 permission may be granted to the appellant to withdraw the appeal with a liberty to approach appropriate authority as per law.  Advocate of the respondent has no objection. 

Hence, the appeal is disposed of as withdrawn with liberty to the appellant to approach appropriate authority as per law. 

No order as to cost.
