For convenience both the appeals are taken up for hearing analogously. In course of the hearing, both the Appellants have expressed their views that they do not want to press the appeal in view of the fact that M/s Andaman Trading Private Ltd., a Commercial Unit in Port Blair, Appellant in Appeal No. 3/2001, has admitted that a commercial Organization should maintain a cordial relation with the Consumer and accordingly the Appellant does not want to press this appeal in this matter. Appellant wants to pay the awarded amount in lieu of the cost of the Battery and cost of litigation which the Consumer couldn’t utilise fully and effectively.
The Appellant Shri Jijith Rekh, in Appeal No. 1/2001, has also expressed his desire to withdraw the appeal in as much as, Respondent, M/s Andaman Trading Pvt. Ltd., has accepted their liability to reimburse the awarded sum towards cost of battery and litigation cost and they have shown a good gesture. The Appellant appreciates the stand taking by the M/s Andaman Trading Private Ltd and accordingly does not want to press this appeal. In such view of the matter both the appeals stand dismissed for non prosecution
The Appellant M/s Andaman Trading Private Ltd., in appeal No.3/2001 has given undertaking through its Director, Shri Mahesh Sharma, to pay Rs. 3600/- the awarded amount by tomorrow 30.5.2001, by account payee check in favour of M/s Raga Sumam, which will be delivered to Mr Arul Prasad Kumar, Learned Advocate appearing on behalf of the Appellant Shri Jijith Reich, proprietor of M/s Raga Sumam, who will accept the cheque against acknowledgement and he will issue a money receipt to M/s Andaman Trading Private Ltd.
Appeals are disposed of accordingly. No order as to cost.
