ORDER

THIRU. M. MONY, PRESIDENT

 

This complaint has been filed by the complainant against the opposite parties 1 to 7 under section 12 of the Consumer Protection Act, 1986 praying to complete all the pending works as per para No.15 & 16 of her complaint and deliver the flat bearing No.104 on the 1^st Floor in Block/ Tower35 of the residential project known as UNIHOMES having a built up area of 700 sq. ft. with one covered park space as per the specification, after collecting the balance amount of Rs.2,06,068/- from the complainant, to pay a sum of Rs.10,000/- being he rental amount paid by the complainant from January, 2015 to till the date of the compliant and also to reimburse the future amount at the rate of Rs.10,000/- per month from August 2015 to till the handing over the flat duly completed in all respects as per the specification and its amenities, to provide all the amenities as per the brochure and specification as pointed out in para No.3 of the complaint, to pay a sum of Rs.3,10,916/- being the interest at the rate of 18% upto the date of complaint and also to pay future interest from the date of the complaint till date of handing over the constructed area to the complainant on the amount paid by the complainant, to pay a sum of Rs.35,000/-  being delayed period compensation upto October, 2015 and also, directed to pay future amount at the rate of Rs.5/- per sq. ft. till date of handing over the complainant’s flat duly completed in all respects as per the specifications and amenities and to pay a sum of Rs.2,00,000/- towards compensation for  unfair trade practice, mental agony, loss of comforts, physical strain and strain to the complainant.

Proof Affidavit of the complainant is not filed for a long time to prove the allegations raised in the complaint.  The complainant called absent for a long time.  The complainant’s Counsel reported no instruction.  Hence, this complaint is dismissed for default.
