JUDGMENT

Both sides represented through counsel. It is submitted that the dispute in this case has been settled. The terms of the compromise are set out in the compromise memo submitted. Therefore, this complaint is disposed of in terms of the compromise entered into between the parties. The terms of the compromise shall form part of this judgment.
Terms of the compromise
- The 1st respondent has agreed to set off an amount of Rs. 75,000/- from the total amount of Rs. 2,25,842/- payable by the complainant towards the apartment cost of 2 E in Sowparnika River View Garden-V.
- The 1st opposite party agrees to execute sale deed with respect to Flat No. 2 E, Sowparnika River View Garden phase 5 Project within one month from the date the complainant clearing the apartment cost as mentioned in paragraph 1 along with the cost of stamp paper and other registration charges.
- The stamp paper and the registration charges with respect to the execution of the sale deeds shall be borne by the complainant and the complainant agrees to handover the said sum to the 1st opposite party, 15 days prior to execution of the sale deed.
- All disputes relating to the consumer case C.C. No. 133 of 2019 and with regard to apartment 2 E in Sowparnika River View Garden phase 5 Project has been full and finally settled between the parties and the complainant agreed to withdraw the complaint pursuant to the compromise.
