The Complaint took a world famous tour “Wonders of the East” with OP, for 4 members of his family that included 2 old ladies needing wheel chair, throughout. During the tour he encountered difficulties because of no wheel chair for the ladies, who had to sit back, due to no such facility. Complainant later on requested to 2 day add on tour of do it yourself basis, to the tour of Singapore taken by Complainant with OP. He expected breakfast included, but this was not so, and OP stated Sri Lanka hotel reservation voucher at the back stated that it did not include breakfast. He has listed various other facts of other Tourist Companies offering the same tour at lesser cost, the changing of dollar at higher rate, and other numerous instances, in which the tour was not as per expectations. He took the matter with OP by writing on 04.12.11, on return from tour. The OP replied and made some clarifications, which are on record. The OP offered Rs.2,290/- spent on breakfast in Srilanka hotel. The Complainant did not feel satisfied and described the tour as ‘disastrous Tour’ & filed this complaint.
OP in its reply has explained in details on each aspect and the nature of arrangement and role of others in such tour. The OP filed a sketch replication, not able to deny many facts mentioned in reply.
We have summarily considered the case of both the parties. It is patent that OP should have made arrangement for wheel chairs for old ladies on chargeable basis, as complainant was willing to pay. A little more attention this aspect would not have spoiled tour. Numerous other complainants cannot be raised after the tour, nor such things can be weighed in gold scale, nor can we go into accounts of each failing expectations. Considering all aspects and feelings of dissatisfaction by complainant, we determine a lump sum compensation of Rs.50,000/- for all inconveniences and allow Rs.20,000/- as litigation expenses.
The order shall be complied with within 30 days of the receipt of the copy of the order; otherwise action can be taken against OP under Section 25 / 27 of the Consumer Protection Act.
File be consigned to record room.
Copy of the order be sent to the parties free of cost.
