Decree holders have filed this application seeking refund of the excess payment made by them to the Judgment debtor. On instruction from the Judgment debtor Shri Narayan states that Judgment debtor has remitted amount of Rs.1,00,469/- which was recovered in excess, to the Decree holders on 15th March 2010 by Registered Post. With this remittance, the application is dismissed as recovery becomes infructuous. In case of difficulty in realizing the amount it will be open to the Decree holders to get these proceedings revived.
