Complainant purchased a paper plate manufacturing machine from the opposite party for a total consideration of Rs.1,25,000/-. At the time of purchase, opposite party agreed to buy the plates manufactured for 100kg material. There after opposite party failed to keep up the promise. Hence the complainant prays return for Rs.1,25,000/- being the price of the machine together with Rs.1,00,000/- as compensation.
Complaint posted for hearing on admission. Complainant present. Heard.
On going through the complaint it is seen that there is no allegation as to any defect in the machine supplied by opposite party. The only allegation is with respect to the breach of contract entered in to between the complainant and opposite party. The subject matter of the dispute being breach of contract, the forum lacks jurisdiction to enterain the complaint.
Hence without going into the merits of the case, we dismiss the complaint, with a direction to approach appropriate court for relief.
