By Smt. Padmini Sudheesh, President The complaint is filed to get back the amount deposited in the respondent firm. The case is as follows : The complainant has deposited Rs.50,000/- on 16/12/2000 vide receipt No.1037/206/--. It was agreed to pay interest at the rate of 16.5% on deposit amount. The respondents had paid interest till 30/6/2007 and no payment after that even though the complainant requested the deposited amount with interest. A lawyer notice has issued on 16/12/2000. But the notice returned as unclaimed. Hence the complaint filed. 2. The respondents called absent and set exparte. 3. The complainant has filed affidavit and produced documents to prove his case and they are marked as Exhibits P1 to P3. 4. The complainant’s case is that he has deposited Rs.50,000/- in the respondents firm on 16/12/2000 vide receipt No.1037/206/00. It was agreed to pay interest @ 16.5%. The respondents have paid interest till 30/6/07. But the deposited amount has not refunded. According to the complainant he is entitled to get Rs.50,000/- and interest @ 16.5% from 1/7/2007. 5. There is no evidence to the contrary. 6. In the result complaint is allowed and the respondents are directed to pay the amount stated in Exhibit P3 receipt with interest at the rate of 16.5% from 1/7/07 till realization and Rs.1,000/- (Rupees One Thousand only) as cost within one month.
