This complaint has been filed by the complainants against the opposite party under section 12 of the Consumer Protection Act, 1986 praying to complete the construction and hand over the possession of the residential apartment consisting of two bedroom, hall, kitchen having super built up area of 608 sq. ft. bearing No.4012, Third Floor in Block C, Brindavan within the stipulated time, to refund a sum of Rs.4,37,093/- with interest at 18% p.a., to pay a compensation of Rs.1,36,800/- to the complainants for the delay in delivery of possession for the period from January 2013 to September 2016, to pay a compensation to the complainants at the rate of Rs.3,040/- per month from October 2016 to till the date on which possession of residential apartment is delivered to the complainants and pay a sum of Rs.7,50,000/- towards compensation for untold hardship, mental agony and monetary with cost of Rs.25,000/- to the complainants.
The complainant’s Counsel filed a Memo stating that the complainant is praying for withdrawal of the case which is recorded. In view of the Memo, this case is dismissed as withdrawn. The withdrawal Memo form part of the order.
