ORDER

Per Shri P.N.Kashalkar, Hon’ble Presiding Judicial Member:

Heard. Service affidavit filed today by the Counsel for the appellant-taken on record. In view of Hon’ble National Commission order quashing and setting aside the order passed by the State Commission, Mumbai and remanding the complaint back to the Additional District Consumer Redressal Forum, Thane expressively on the revision petition filed by the appellant herein, the Counsel for the appellant/complainant  herein seeking withdrawal of the appeal.  Hence, we pass the following order:-

 

                                        :-ORDER-:

1. Appeal stands dismissed as withdrawn.  Further we make it clear to the District Consumer Disputes Redressal Forum  that all the points the complainant wants to raise before the District Consumer Redressal Forum should be allowed to raise and they should be considered by the Forum in right prospective in the light of the observations made by the Hon’ble National Commission.  

2. No order as to costs.

3. Copies of the order herein be furnished to the parties as per rule.
