All these complaints have been filed by different complainants against one and the same OPs with similar prayer.  Therefore, all these complaints have been clubbed together and disposed off under this common order.

 

2. The complainants have filed these complaints U/s.12 of the Consumer Protection Act, 1986 against the Opposite Parties (herein after referred as OPs) with a prayer to direct them to refund the advance amount paid by them for purchasing sites together with interest @ 18% p.a and compensation of Rs.1,00,000/- with litigation cost.

 

3. The brief averments made in all these complaints are as under:

 

The OPs are real estate promoters and property developers engaged in the business of developing, marketing residential sites in and around Mysore / Bangalore.  The OPs proposed to form residential layouts under the various survey numbers at;

 

(1) Maratikyatanahalli Village, Jayapura Hobli, Mysore Taluk and Mysore District,

 

(2) Chikka Hullur Village, Kasaba Hobli, Hosakote Taluk and Bangalore District,

 

(3) Billakempanahalli Village / Abbanakuppe Village / Ittamadu Village, Bidadi Hobli, Ramanagar Taluk and District,

 

(4) Huyilala Village, Yelavala Hobli, Mysore Taluk and Mysore District,

 

(5) Kengeri Village, Kengeri Hobli, Bangalore South Talu, Bangalore District &

 

(6) Thattamachanahalli Amanikere Village, Bullahalli Village and Venkatagirikote Village, Vijayapura Hobli, Devanahalli Taluk, Bangalore Rural District under the name and style “Royal Enclave” / “My County” / “Wellington” / “Hoston” / “New Citi” / “Royal County” / “Samyuktha Enclave” / “Aerozonaa” / “New County”.  The OPs offered sites to the complainants for a total consideration as mentioned against each of the complainants in the following table.  The complainants having agreed to purchase the sites, paid certain advance amount and the OPs executed agreements of sale in favour of each of the complainants mentioning the advance amount received from each one of them by cash/cheque with a promise that the registered sale deed would be executed in favour of each of the complainants by receiving balance consideration amount after complete formation of the layout and after getting necessary approval from the competent authorities.

The OPs thereafter failed to develop the layout and as and when the complainants visited they promised them that the layout would be developed as early as possible and they will execute the registered sale deed in favour of each of the complainants by receiving balance consideration amount at an early date.  That, the OPs went on postponing the execution of the registered sale deed on one or the other pretext.  The complainants after having waited for more than 7-8 years demanded the OPs to refund the advance amount as they have failed to form the layout and execute the registered sale deed in their favour.  The OPs failed to refund the advance amount received from each of the complainants and vanished from the scene.  Thereafter, the complainants having no other option got issued legal notice to the OPs calling upon them to refund the advance amount paid by each one of them.  However, the OPs failed to respond to the said legal notice.  Therefore, the complainants aggrieved by the deficiency of service on the part of OPs approached this Forum by filing these complaints with a prayer to direct the OPs to refund them the advance amount received by them together with interest @ 18% p.a and compensation of Rs.1,00,000/- for having caused mental agony, hardship and inconvenience together with cost of litigation.

 

4. After admitting the complaints registered notices were issued to the OPs.  Despite service of notice of the complaints, OP failed to appear and contest the complaints and therefore they were placed ex-parte.

Thereafter the complainants were called upon to submit their evidence by way of affidavit.  Accordingly, each of the complainants have submitted their evidence by way of affidavit reiterating the allegations made in their respective complaints.  All the complainants have produced the copies of agreements of sale executed by the OPs in their favour as well as the receipts evidencing the payment of advance amount.

 

6. Perused the allegations made in the complaints, sworn testimony of the complainants, copies of agreements of sale, receipts and other materials placed on record.

The allegations made in the complaint, sworn testimony of the complainants coupled with copies of agreements of sale and the receipts go to establish that the complainants attracted by the promises made by the OPs decided to purchase residential sites in the layouts to be formed by the OPs near Mysore/Bangalore and have paid advance amount towards purchase of the sites as mentioned in the above table by way of cash/cheque, for which OPs have issued receipts in favour of each of the complainants.

Admittedly, the OPs have failed to develop any of the layout as promised by them.  It appears even today the residential layout as promised by the OPs have not been developed and ready for allotment.  The OPs even after period of 6-7 years from the date of execution of agreement of sale have failed to develop the sites and execute the registered sale deeds in favour of the complainants by receiving balance consideration amount as promised by them at the time of execution of agreements of sale.  This conduct of OPs amounts to grave deficiency of service.  OPs have also failed to refund the advance amount to the complainants after having failed to develop the residential layout as promised by them, even after period of 6-7 years.  The conduct of OPs must have put the complainants to great hardship, inconvenience and mental agony.  Therefore, the OPs are also liable to pay compensation to the complainants apart from refunding the advance amount together with interest.

In view of the discussions made above, we are of the considered opinion that, the complainants have successfully proved the deficiency of service on the part of the OPs.  Therefore, the OPs have to be directed to refund advance amount received from each one of the complainants together with interest @ 18% p.a from the date of actual receipt till the date of realization.  Further OPs are directed to pay compensation of Rs.1,00,000/- to each one of the complainants for having caused hardship, inconvenience and mental agony together with litigation cost of Rs.2,000/-.

   

10. In the result, we proceed to pass the following:

The complaints filed by the complainants U/s.12 of the Consumer Protection Act, 1986 are allowed in part.

 

The OP/s in complaint No.437/2016 are directed to refund advance amount of Rs.2,50,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.439/2016 are directed to refund advance amount of Rs.3,00,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.440/2016 are directed to refund advance amount of Rs.3,20,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.441/2016 are directed to refund advance amount of Rs.1,50,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.442/2016 are directed to refund advance amount of Rs.2,00,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.443/2016 are directed to refund advance amount of Rs.5,00,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.460/2016 are directed to refund advance amount of Rs.4,32,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.465/2016 are directed to refund advance amount of Rs.2,30,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.466/2016 are directed to refund advance amount of Rs.2,30,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.467/2016 are directed to refund advance amount of Rs.1,50,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.468/2016 are directed to refund advance amount of Rs.1,76,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.469/2016 are directed to refund advance amount of Rs.3,66,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.470/2016 are directed to refund advance amount of Rs.2,80,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.471/2016 are directed to refund advance amount of Rs.1,80,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.472/2016 are directed to refund advance amount of Rs.3,00,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.473/2016 are directed to refund advance amount of Rs.2,50,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.474/2016 are directed to refund advance amount of Rs.2,00,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.475/2016 are directed to refund advance amount of Rs.2,30,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s in complaint No.476/2016 are directed to refund advance amount of Rs.3,50,000/- to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.

 

The OP/s are directed to pay compensation of Rs.1,00,000/- to each one of the complainants for deficiency of service on their part together with litigation cost of Rs.2,000/-.

 

The OPs shall comply the order passed by this Forum within six weeks from today.

 

          Send the copy of the order to both the parties free of costs.
