Present : Proxy for complainant and OP-2.

Argument heard.

 

The short facts of complaint are that complainant purchased a bottle of coco cola on 22.11.2008.  She notices some food poison in the said bottle before opening it.  OP filed reply and denied all allegations.  They also denied the cash memo and there was no serial number and date.

Scrutiny of record reveals that complainant has not placed any evidence on record regarding the food poison contained in the bottle nor brought the bottle in question for inspection in Forum.

Hence, the complaint being devoid of any merit is dismissed.

File be consigned to record room.

Copy of the order be sent to the parties free of cost.

        Pronounced in open Court on 10.08.2015.
