  1. This is an application   filed by the complainant  U/s.27  of the Consumer Protection Act seeking to initiate necessary proceedings against the respondents/opposite parties for non-compliance of the common orders dated 27.4.2012 passed in CC 53 of 2011 on the file of this Commission and orders dated 08.07.2013 passed in FA No. 376 of 2012 on the file of the Hon’ble National Commission and punish them  as per the provisions of Section 27 of the Consumer Protection Act.

 

  1.  Counsel on both sides present. Heard.

 

  1. Counsel for the proposed State Bank of India filed Memo,  along with the receipt said to have been issued by Mr. M.B.V. Rama Rao, authorized representative of the applicant/complainant,  Lokesh Kumar Kosaraju, wherein, it is  acknowledged  the receipt of R..6,29,603/- ( Rupees Six Lakhs  Twenty Nine Thousand Six Hundred and Three) only from M/s. Hill County Properties Limited by way of Cheque bearing No. 184438 dated October, 20, 2016 towards refund of the EMI(s) amount paid into the Housing Loan Account of Lokesh Kumar Kosaraju with interest towards full and final settlement of the case and they have  no claim against the State Bank of India and M/s. Hill Country Properties Limited in this regard, and requested to record the settlement of the case between the complainant and opposite parties and dispose of the case as settled out of court..

 

  1. In view of the above facts and circumstances Memo recorded and  the E.A. is closed as settled out of court towards full and final settlement. Since EA is closed, EAIA 186 of 2016 is dismissed as infructuous.  No costs.
