This complaint has been filed before DCDRC, Chennai (North) as CC.No.64/2019 and transferred to this commission by the order of the Hon’ble State Consumer Disputes Redressal Commission, Chennai and taken on file as CC.No.75/2022.
The complaint was filed by the complainant under section 12 of the Consumer Protection Act 1986 alleging deficiency in service along with a prayer to direct the opposite parties to pay a sum of Rs.29,000/- representing the entire amount paid by the complainant together with penalty and to pay a sum of Rs.5,00,000/- towards compensation for the mental agony and hardship caused to the complainant and to pay a sum of Rs.4,70,000/- towards cost of the complaint to the complainant.
No representation for complainant inspite of service of notice on 18.05.2022. Written arguments not filed by the complainant. Sufficient opportunities given for filing written arguments and for appearance on 08.08.2022, 23.08.2022, 13.09.2022, 19.09.2022, 06.10.2022, 19.10.2022, 31.10.2022, 08.11.2022 and on 21.11.2022. In spite of the same, complainant failed to appear and prosecute the case. Hence, this commission is of the view that no purpose in keeping the complaint on file. Hence the consumer complaint is dismissed for non prosecution. No cost.
This order was pronounced by us in the open Commission on this 21st November 2022.
