This complaint has been filed before DCDRC, Chennai (North) as CC.No.25/2019 and transferred to this commission by the order of the Hon’ble State Consumer Disputes Redressal Commission, Chennai and taken on file as CC.No.51/2022.             
  The complaint was filed by the complainant under section 12 of the Consumer Protection Act 1986 alleging deficiency in service against the opposite party along with a prayer to direct the opposite party to refund a sum of Rs.60,000/- amount collected from the complainant and to pay a sum of Rs.1,00,00,000/- towards compensation for the mental agony and hardship caused to the complainant due to the deficiency in service on the part of the opposite parties along with cost.
No representation for complainant inspite of service of notice. Sufficient opportunities given to the complainant for filing proof affidavit and for appearance on 25.07.2022, 12.08.2022, 17.08.2022, 08.09.2022, 15.09.2022, 29.09.2022, 17.10.2022, 07.11.2022, 21.11.2022, 29.11.2022, 12.12.2022, 21.12.2022, 03.01.2023, 23.01.2023 and on 31.01.2023. In spite of the same, complainant failed to appear and prosecute the case. Hence, this commission is of the view that no purpose in keeping the complaint on file.  Hence the consumer complaint is dismissed for non prosecution.  No cost.
This order was pronounced by us in the open Commission on this 31st January 2023.
