The complainant has filed this application seeking permission to withdraw the complaint and in case of failure of the opposite party to make the payment as referred to in the application to grant permission to the complainant to apply for restoration of the complaint.  The Memorandum of Understanding reached between the parties has been filed.

          We have heard Mr. S.M. Tripathi,  In view of the submissions made, the application is allowed and the complaint is dismissed as withdrawn with the above stipulation that in case the amount is not paid, it will be open for the complainant to seek restoration of the complaint.
