ORDER

Order dated 30.10.2008 This is a complaint filed by the complainant to direct the opposite parties to refund Rs.4,82,000/- with interest and the compensation. The case of the complainant is that, he has deposited Rs.4,82,000/- with the opposite parties on different dates right from 2004 to 2005 under various receipts. The complainant has produced copies of receipts. The total amount covered under the deposit receipts comes to Rs.4,82,000/-. It is the case of the complainant that the opposite parties have cheated the depositors and Police have registered various criminal cases against the opposite parties. Notice was sent to opposite parties through Superintendent of Central Jail, Parappanagrahara since, the opposite parties are lodged in the Central Jail in connection with Criminal Cases registered against them. The opposite parties have not sent defense version and they have not engaged the Advocates. In other connected complaints the matters have been disposed off and the opposite parties have been directed to pay the amount with interest and several execution petitions are pending against the opposite parties in District Consumer Forums. The case made out by the complaint has gone unchallenged. There is no defense version. There is nothing to disbelieve the case of the complainant. Since the complainant has deposited Rs.4,82,000/- with the opposite parties under various receipts on several dates. The opposite parties have not repaid or refunded the amount. Therefore, it is just and proper to direct the opposite parties to refund the amount of Rs.4,82,000/- to the complainant with interest. The complainant has prayed Rs.50,000/- as compensation. It is not proper and just to award compensation as requested by the complainant since we are awarding interest on the deposit amount. In the result, I proceed to pass the following:- ORDER 2. The complaint is allowed. The opposite party are directed to refund Rs.4,82,000/- to the complainants with interest at 24% p.a from the date of respective deposits till payment/realisation. The complainant is also entitled to Rs.2,000/- towards cost of the present proceedings. 3. Send the copy of this Order to both the parties free of costs immediately. 4.
